Before getting into Our Privacy Policy below and what it covers, here are a few things you should know. The Pilly website (“Pilly.com” or the “Website”)  is owned by Pilly LLC (“Pilly”, “We”, “Our”, or “Us”) and Pilly is the sole owner of information collected on this Website.

If you use Our Website, you must comply with Our Terms of Use (“Terms”). If you do not agree to these Terms, please do not use Our Website, products, and/or services and exit the Website immediately.

Please know that We are committed to maintaining your privacy. Thank you for entrusting Pilly with the personal information, including prescription data, that We receive from you (more on this topic below). We understand that this data may be sensitive. Our Privacy Policy describes the personal information collected by or on behalf of Pilly through the Website and Our interactions with you, and how personal information is used, shared, and protected. We also appreciate you taking the time to look over Our Privacy Policy and hope that We have organized it in a way that makes it easy to read. Here are the key things We’d like to bring to your attention:

  • Pilly does not sell or share your prescription data--information regarding your prescription drugs that are linked to your name, contact information, and other personal data you provide Us.

  • In limited cases, Pilly may use prescription data, which is linked to your name and contact information, to perform internal business operations, analytics, and audits with health care providers that will help Us improve Our product and service offerings.

  • Any prescription data that We may receive references a prescription that you’ve filled using Our program, including: the drug class, name, dosage, form, and quantity. Unless you’ve given it to Us, We don’t have access to the rest of your medical history or other medical information.

1. Personal Information We Collect

A.  Identifiers: Identifiers such as: a real name, alias, date of birth, postal address, unique personal identifier, online identifier, internet protocol address (“IP Address”), email address, or other similar identifiers.

B. Customer Records: Any of the following types of information: telephone number, information related to your use of Our services or discounts, including information about your prescription medications.  

C.  Commercial Information: Commercial information, including records of products or services purchased, obtained, or considered, or other consuming histories or tendencies when using Our services or discounts. 

D.  Internet Activity: Internet or other electronic network activity information, including, but not limited to, browsing history, search history, and information regarding a consumer’s interaction with an internet website, application, or advertisement.

This Policy does not apply to any information that is publicly available.

Information from Logs

When you access the Website, Our servers automatically record certain information. These logs include information such as the date and time you access Our Website, the browser you are using, and other common browser information. Information from Embedded Scripts

Client-Side Scripting (embedded scripts) is code that exists inside Our HTML page. This code will be processed on Our machine and the HTML page will NOT perform a Postback to the web server. Generally, Our scripting is used for page navigation, data validation, and formatting.

Information from “Internet Tags”

“Internet Tags” are also known as single-pixel GIFs, clear GIFs, invisible GIFs, and 1-by-1 GIFs, and are smaller than cookies and tell the Website server information such as the IP address and browser type related to the visitor’s computer. Tags may be placed both on online advertisements that bring people to the Website and on different pages of the Website. Information We Receive from Pharmacy Benefit Managers 

Most prescriptions in the United States, including prescriptions filled through the use of discount cards and/or coupons or insurance cards, are administered by Pharmacy Benefit Managers (PBMs). The purchases result in the pharmacy reporting patient data back to the PBM that provides the benefit. When you use a card and/or coupon provided by Pilly, We may receive information about the transaction from the corresponding PBM.

3. Purpose for Collecting Personal Information

We may use all categories of personal information listed above for the following business purposes:

As Stated or Agreed to at the Point of Collection. We may use personal information for the purposes stated or agreed-to (or as is obvious) at the point of collection. For example, We use personal information to respond to your questions, comments, or complaints. We may also use personal information as requested or consented to by you.

Administration. We use personal information for administrative purposes, such as facilitating transactions, order fulfillment, member support, and other related actions for providing and maintaining Our services, to inform Our business strategies, improving Our products and services, to understand the Website’s demographics and user preferences, for evaluating applications, and managing profiles.

Website Management. We use personal information for Website management, such as troubleshooting problems, improving the content and functionality of the Website, statistical and other analyses of the Website, and to customize the Website to you and Our users. Pilly rarely shares information with a third party that associates you personally with your specific prescription information. When We do disclose your personal information, Pilly ensures that these third parties are bound to comply with federal standards as to how to handle your personal information. We may share all categories of personal information listed above with the following categories of third parties and/or service providers:

  • We may share personal information with Our employees, subsidiaries, and affiliates who have a need to know the information for Our business purposes.

  • We may use one or more service providers to safeguard, protect, store, and/or analyze data. We will ensure that this is done safely and securely. This includes information security vendors, data security vendors, and threat detection monitoring service providers.

  • We may use other companies to perform services including, without limitation, facilitating some aspects of Our Website, and fulfilling purchase requests. These other companies may be supplied with or have access to your information solely for the purpose of providing these services to Us or on Our behalf. They do not have any independent right to use or disclose your information. We have contracted with Our service providers to protect any such personal information. This includes pharmacies, pharmacy benefit managers, and other healthcare providers, consumer privacy management software, and analytics software.

  • We may share personal information about you to respond to subpoenas, court orders, or other legal processes, or to exercise Our legal rights or defend against legal claims.

  • We will cooperate with law enforcement and other governmental agencies, and may disclose personal information: (i) if We believe in good faith We are legally required to disclose that personal information, (ii) if We are advised to disclose personal information by Our legal counsel, or (iii) when necessary to identify, contact or bring a legal action against someone who may cause or be causing harm to, or interfering with the legal rights of Pilly or any other party.

  • We may share personal information with Our professional advisors, such as Our attorneys, accountants, financial advisors, in their capacity as advisors to Us.

  • We may share personal information with third parties and/or service providers when explicitly requested by or consented to by you, or for the purposes for which you disclosed the personal information to Us as indicated at the time and point of the disclosure (or as was obvious at the time and point of disclosure).

  • Pilly may transfer its user database, including personal information contained therein, to a third party who acquires all, or substantially all, of the assets or stock of Pilly whether by merger, acquisition, reorganization, bankruptcy, receivership, or otherwise. We may provide personal information to the subsequent owner(s), including as part of any due diligence process.

 

5. Use and Disclosure of De-identified or Aggregated Information

We may collect, use, share, transfer and otherwise process de-identified and aggregated information that We receive or create for any purposes in Our sole discretion, in compliance with applicable laws. We are the sole and exclusive owner of such de-identified and aggregated information, including if We de-identify personal information so that it no longer considered personal information under applicable laws.

6. How to Control Use of Your Personal Information

If you would like to delete the personal information you provided Us or otherwise limit the use of the personal information you provided Us, please contact Us at Info@Pilly.com. Keep in mind that there are cases where We are required by federal and state law to keep a copy of the data. 

7. Personally Identifiable Information of Children

Our Website is not intended to be used by children under the age of 13. We do not knowingly collect, use, or share personal information from children under 13. It is Our assumption that Our Website is being used by adults or minors supervised by a parent or guardian. We are committed to complying with the Children's Online Privacy Protection Act ("COPPA").

If you believe your child has provided Us with personal information, send Us an email or a letter with the pertinent details to the address provided below in Section 10. We will make commercially reasonable attempts to delete this information immediately.

We encourage parents to talk to their children about their use of the Internet and the information they disclose to websites.

8. Other Things You Should You Know About Your Privacy

  • Security
    The security, integrity, and confidentiality of your information are extremely important to Us. We have implemented technical, administrative, and physical security measures that are designed to protect your information from unauthorized access, disclosure, use, and modification.   • Violation of Law, Rule or Regulation
    The provisions elaborated herein will not apply in the event that you engage in certain improper conduct. Pilly shall have the right to use or release to third parties personally identifiable information regarding users who use this Website for any unlawful or fraudulent purpose or who engage in conduct which Pilly deems improper.

  • Do Not Track Requests
    Currently, We do not respond to browser "Do Not Track" signals.

  • To Our Visitors Outside of the United States of America
    The Pilly services are intended for use only by residents of the United States of America, including Puerto Rico, Guam and the U.S. Virgin Islands. If you access Our Website from outside the United States, please be aware that personal information may be transferred to, stored in, and processed in the United States. Certain governmental authorities may not consider the level of protection of personal information in the United States to be equivalent to that required in other jurisdictions.
